Welcome to goers.app (“Platform”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of our car rental marketplace, including our website, mobile applications, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Definitions
- “Guest” means a user who rents a vehicle through the Platform.
- “Host” means a user who lists a vehicle for rent on the Platform.
- “Booking” means a confirmed reservation made through the Platform.
- “Vehicle” means any car or other vehicle listed on the Platform.
- “Content” means text, images, reviews, ratings, and other materials.
2. Eligibility and Account Registration
2.1 You must be at least 18 years old (or the legal age in your jurisdiction) to use the Services.
2.2 You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
2.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Platform Role and Marketplace Nature
3.1 The Platform acts as a marketplace connecting Hosts and Guests. We do not own, operate, maintain, inspect, or control Vehicles unless explicitly stated otherwise.
3.2 Any rental agreement is formed directly between the Host and the Guest. The Platform is not a party to such agreements.
4. Listings and Bookings
4.1 Hosts are responsible for ensuring that their Vehicle listings are accurate, complete, and compliant with applicable laws (including insurance, registration, and safety requirements).
4.2 Guests agree to use Vehicles in accordance with the Host’s rules, these Terms, and all applicable laws.
4.3 A Booking is confirmed only after payment is successfully processed and confirmation is issued through the Platform.
5. Pricing, Fees, and Payments
5.1 Prices, fees, taxes, and any additional charges are displayed at checkout.
5.2 The Platform may charge service fees to Hosts and/or Guests for use of the Services.
5.3 Payments are processed through third-party payment providers. By using the Services, you agree to their terms and conditions.
6. Cancellations and Refunds
6.1 Cancellation and refund policies are disclosed at the time of Booking and may vary by Host or Vehicle.
6.2 The Platform may facilitate refunds in accordance with the applicable cancellation policy but does not guarantee refunds outside those terms.
7. Insurance, Damage, and Liability
7.1 Hosts are responsible for maintaining legally required insurance coverage for their Vehicles unless otherwise specified.
7.2 Guests may be responsible for damage, loss, fines, tolls, or violations incurred during a Booking period.
7.3 To the maximum extent permitted by law, the Platform disclaims liability for accidents, injuries, losses, or damages arising from Vehicle use.
8. User Conduct
You agree not to:
- Violate any applicable law or regulation;
- Provide false or misleading information;
- Use the Services for unauthorized or unlawful purposes;
- Interfere with or disrupt the Platform or its security features;
- Harass, abuse, or harm other users.
9. Reviews and Content
9.1 Users may post reviews and other Content, provided it is truthful, lawful, and not misleading.
9.2 By posting Content, you grant the Platform a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such Content in connection with the Services.
10. Suspension and Termination
10.1 We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms or pose a risk to the Platform or other users.
10.2 You may stop using the Services at any time, subject to outstanding obligations related to active or past Bookings.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
13. Indemnification
You agree to indemnify and hold harmless the Platform, its affiliates, and their officers, directors, and employees from any claims, damages, losses, and expenses arising out of your use of the Services or violation of these Terms.
14. Governing Law and Dispute Resolution
14.1 These Terms are governed by and construed in accordance with the laws of the Republic of Tunisia, without prejudice to mandatory consumer protection rules applicable in the user’s country of residence within the European Union.
14.2 Any dispute arising out of or in connection with these Terms or the Services shall fall under the jurisdiction of the competent courts of Tunisia, unless mandatory EU consumer protection laws grant the consumer the right to bring proceedings in their country of residence.
15. Consumer Protection (Tunisia & EU)
15.1 Nothing in these Terms limits or excludes rights granted to consumers under Tunisian Law n°83-117 on consumer protection or applicable EU consumer protection directives, including Directive 2011/83/EU.
15.2 For EU consumers, mandatory rights relating to transparency, withdrawal, refunds, and unfair contract terms shall prevail over any conflicting provision of these Terms.
15.3 Where required by law, information regarding total pricing, taxes, fees, and cancellation conditions shall be provided clearly prior to Booking confirmation.
16. Data Protection and Privacy
16.1 The Platform processes personal data in accordance with:
- 🇹🇳 Tunisian Law n°2004-63 on the Protection of Personal Data; and
- 🇪🇺 Regulation (EU) 2016/679 (GDPR) where applicable.
16.2 The Platform acts as a data controller for personal data processed through the Services.
16.3 Users may be required to provide explicit consent for certain data processing activities, in accordance with applicable law.
16.4 Further information on data processing, user rights, and safeguards is available in our Privacy Policy, which forms an integral part of these Terms.
17. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
